By using our website or placing an order through BigHammerWines.com (“Site”), you agree to the following Terms and Conditions (“Terms”). These Terms govern your use of our Site and services. Throughout this document, “Big Hammer Wines,” “we,” “us,” or “our” refers to Martellotto Inc. and its affiliates.

1. Age Restriction

You must be 21 years or older to purchase wine or access alcohol-related content on our Site. By placing an order, you affirm that you and the recipient are 21+. A valid government-issued ID is required upon delivery. Fraudulent orders by individuals under 21 are grounds for legal action.

2. Orders & Payment

All orders must be paid in full before shipping. Accepted methods: credit card, wire transfer, PayPal, or as specified at checkout. Prices are per bottle unless otherwise noted and may change without notice. We reserve the right to cancel or adjust orders due to errors in pricing, inventory, or promotional codes.

3. Title and Compliance

All wine is sold in California. Title passes to you when your order leaves our warehouse. It is your responsibility to ensure compliance with the laws of your destination state. We do not guarantee the legality of shipping to your location.

4. Shipping & Delivery

Shipping fees are calculated at checkout. We ship via third-party carriers. Shipping to P.O. boxes, APO/FPO addresses, or internationally may be restricted.

We are not liable for delays caused by weather, carrier operations, or incorrect addresses. To prevent heat/cold damage, we recommend contacting us prior to ordering during extreme weather.

IMPORTANT: If wine is shipped during periods of extreme temperature or without proper coordination, Big Hammer Wines is not responsible for any resulting damage.

5. Tracking & Account Management

Tracking numbers will be sent via email. By registering an account, you gain access to order history, tracking, and exclusive member offers. Cookies are used to streamline your shopping experience.

6. Returns & Cancellations

Contact us within 14 days if you are dissatisfied. Eligible returns must be in original packaging. A 10% restocking fee applies to processed orders. We do not accept returns for changes in market pricing or corked bottles. Refunds are issued to the original payment method once returned items are received and verified. We reserve the right to decline returns at our discretion.

7. Insurance

All shipments are insured up to $100. Additional insurance may be purchased. Weather damage is not covered by default.

If your item arrives broken, you must retain all packaging and notify us immediately to file a claim. Without packaging and proof, we cannot file insurance claims.

8. Digital Content and Disclaimers

We publish product descriptions, ratings, media, and tasting notes provided by third-party wineries, suppliers, and content partners. These materials are for informational purposes only and may not reflect real-time updates or corrections. We do not independently verify supplier-reported data including but not limited to:

• Alcohol percentage, vintage accuracy, vineyard source, or grape composition
• Organic, biodynamic, natural, or sustainability certifications
• Ingredient content or allergen presence
• Nutritional or caloric information

Promotions and Media Disclaimer: While we strive for accuracy, promotional materials (emails, blog posts, videos, and social media) may contain errors, timing discrepancies, or typographical mistakes. Participation in marketing or promotional programs does not create a binding agreement unless explicitly stated in writing.

Health and Medical Disclaimer: We are not medical professionals. Any references to health benefits, wellness, dietary effects, or personal testimonials are anecdotal and not intended as medical advice. Please consult your physician or a qualified health provider before acting on any content.

Digital Publishing Disclaimer: We may revise or withdraw offers and content at any time due to inaccuracies, discontinuations, or legal changes. Big Hammer Wines shall not be liable for reliance on outdated or inaccurate media, product imagery, or descriptions.

11. Limitation of Liability

To the fullest extent allowed by law, Big Hammer Wines disclaims liability for damages arising from your use of the Site or any purchased products. In no event will our liability exceed the amount you paid to us.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of the State of California. All disputes must be resolved in state or federal courts in San Diego County, California.

• You have the right to opt out of the sale or sharing of your personal information.
